At United States Practical Shooting Association (for purposes of this Privacy Policy, “USPSA”, “we”, “our”, or “us”), we take your privacy seriously. Please read this Privacy Policy to learn how we treat your personal data if you use our informational website and all our Applications that reference this Privacy Policy (an “App” or “Apps”) (collectively, the “Services”).  By using or accessing our Services in any manner, you acknowledge that you accept the practices and policies outlined below, and you hereby consent that we will collect, use and share your information as described in this Privacy Policy.  

Remember that your use of USPSA’s Services is at all times subject to our Terms and Conditions of Use (“Terms of Use”) which incorporates this Privacy Policy. Any terms we use in this Policy without defining them have the definitions given to them in the Terms of Use

As we continually work to improve our Services, we may need to change this Privacy Policy from time to time. Upon such changes, we will alert you to any such changes by placing a notice on the USPSA website, by sending you an email or by some other means. Please note that if you’ve opted not to receive legal notice emails from us (or you haven’t provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes.

Your privacy is important to us. It is USPSA's policy to respect your privacy regarding any information we may collect from you across our website, https://uspsa.org, and other sites we own and operate.

 

1. Information we collect

This Privacy Policy covers how we treat Personal Data that we gather when you access or use our Services. “Personal Data” means any information that identifies or relates to a particular individual and also includes information referred to as “personally identifiable information” or “personal information” under applicable data privacy laws, rules or regulations. This Privacy Policy does not cover the practices of companies we don’t own or control or people we don’t manage.

Log data

When you visit our website, our servers may automatically log the standard data provided by your web browser. It may include your computer’s Internet Protocol (IP) address, your browser type and version, the pages you visit, the time and date of your visit, the time spent on each page, and other details.

Device data

We may also collect data about the device you’re using to access our website. This data may include the device type, operating system, unique device identifiers, device settings, and geo-location data. What we collect can depend on the individual settings of your device and software. We recommend checking the policies of your device manufacturer or software provider to learn what information they make available to us.

Personal information

We may ask for personal information, such as your:

  • Email
  • Social media profiles
  • Date of birth
  • Phone/mobile number
  • Home/Mailing address
  • Payment information

 

2. Legal bases for processing

We will process your personal information lawfully, fairly and in a transparent manner. We collect and process information about you only where we have legal bases for doing so.

These legal bases depend on the services you use and how you use them, meaning we collect and use your information only where:

  • it’s necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract (for example, when we provide a service, you request from us);
  • it satisfies a legitimate interest (which is not overridden by your data protection interests), such as for research and development, to market and promote our services, and to protect our legal rights and interests.
  • you give us consent to do so for a specific purpose (for example, you might consent to us sending you our newsletter); or
  • we need to process your data to comply with a legal obligation.

Where you consent to our use of information about you for a specific purpose, you have the right to change your mind at any time (but this will not affect any processing that has already taken place).

We don’t keep personal information for longer than is necessary. While we retain this information, we will protect it within commercially acceptable means to prevent loss and theft, as well as unauthorized access, disclosure, copying, use or modification. That said, we advise that no method of electronic transmission or storage is 100% secure and cannot guarantee absolute data security. If necessary, we may retain your personal information for our compliance with a legal obligation or in order to protect your vital interests or the vital interests of another natural person.


3. Collection and use of information

We may collect, hold, use and disclose information for the following purposes and personal information will not be further processed in a manner that is incompatible with these purposes:

  • to enable you to customize or personalize your experience of our website.
  • to enable you to access and use our website, associated applications, and associated social media platforms.
  • to contact and communicate with you.
  • for internal record keeping and administrative purposes.
  • for analytics, market research and business development, including to operate and improve our website, associated applications, and associated social media platforms.
  • to run competitions and/or offer additional benefits to you.
  • for advertising and marketing, including to send you promotional information about our products and services and information about third parties that we consider may be of interest to you.
  • to comply with our legal obligations and resolve any disputes that we may have; and
  • to consider your employment application.

 

4. Disclosure of personal information to third parties

We may disclose personal information to:

  • third party service providers for the purpose of enabling them to provide their services, including (without limitation) IT service providers, data storage, webhosting and server providers, debt collectors, maintenance or problem-solving providers, marketing or advertising providers, professional advisors, and payment systems operators.
  • our employees, contractors and/or related entities.
  • sponsors or promoters of any competition we run; and
  • courts, tribunals, regulatory authorities, and law enforcement officers, as required by law, in connection with any actual or prospective legal proceedings, or in order to establish, exercise or defend our legal rights.

5. Sharing Your Personal Data with Advertising and Marketing Partners

Some of the above sharing and use of your information is only done where we have obtained your consent to do so. For example, we may ask your consent to provide your Personal Data, including IP address information, interest data, unique IDs and other information to certain third parties that help us advertise and market our services. In those instances where we ask your consent, we will only share your information with those third parties where you have given us permission to do so. You can withdraw your consent at any time by contacting us using the contact information listed in the “Contact Us” section below.

No mobile information will be shared with third parties/affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

 

6.International transfers of personal information

The personal information we collect is stored and processed in United States, or where we or our partners, affiliates and third-party providers maintain facilities. By providing us with your personal information, you consent to the disclosure to these overseas third parties.

We will ensure that any transfer of personal information from countries in the European Economic Area (EEA) to countries outside the EEA will be protected by appropriate safeguards, for example by using standard data protection clauses approved by the European Commission, or the use of binding corporate rules or other legally accepted means.

Where we transfer personal information from a non-EEA country to another country, you acknowledge that third parties in other jurisdictions may not be subject to similar data protection laws to the ones in our jurisdiction. There are risks if any such third party engages in any act or practice that would contravene the data privacy laws in our jurisdiction and this might mean that you will not be able to seek redress under our jurisdiction’s privacy laws.

 

7. Privacy Rights for USA Residents

Residents of certain states within the United States have consumer rights under state privacy laws.  If you wish to exercise such consumer rights, please submit a request to: [email protected]. We will determine your state of residence from information you provide and/or information we have about you, and respond according to which state’s laws are applicable to you, usually within 45 days unless we seek an extension from you. In some cases, we may request that you provide us with additional information, which may include Personal Data, if necessary to verify your identity and the nature of your request. We will respond to your request in writing through your account with us, or, if no account exists, in a reasonable manner that you provide in your request. If we are unable to verify your identity or for other permitted reasons, we may decline to respond to your request and will inform you that we have declined the request, at which time you may submit an appeal to [email protected]. Please clearly mark this communication as an “Appeal” and provide information regarding the original request. If we decline your appeal, you may choose to file a complaint with your state’s Attorney General or designated consumer advocate for such complaints.  

 

Your consumer rights typically include the following but may vary from state to state:

  • Access:  You can request whether we collect Personal Data about you and you may request a copy of such Personal Data. Your copy of your Personal Data will be in a portable format that should be readily transferable to another entity, if feasible.  
  • Correction:  If you believe that any Personal Data we are holding about you is incorrect or incomplete, you can request that we correct or supplement such data.  
  • Deletion:  You can request that we delete some or all of your Personal Data from our systems, subject to various exceptions, including without limitation, the need to retain such data to complete a transaction you requested, to retain records for legal purposes, or other reasons authorized by law.
  • Withdrawal of Consent:  If we are processing your Personal Data based on your consent (as indicated at the time of collection of such data), you have the right to withdraw your consent at any time. Please note, however, that if you exercise this right, you may have to then provide express consent on a case-by-case basis for the use or disclosure of certain of your Personal Data, if such use or disclosure is necessary to enable you to utilize some or all of our Services.  
  • Opt-out:  You can opt-out of the use or disclosure of your Personal Data for certain purposes by contacting us at [email protected], including:
    1. Sale of your Personal Data (exchanging your Personal Data with a third party for monetary or other valuable consideration);
    2. Targeted advertising (ads selected for you on the basis of your online activities at unaffiliated websites over time);
    3. Profiling (automated processing of your Personal Data to analyze or predict your behavior, movement, and preferences).
  • Restriction of Processing of Sensitive Personal Data:  You can request that we restrict use and processing of your Sensitive Personal Data, which may include, without limitation, driver’s license numbers, credit card numbers, passport numbers, citizenship status, union membership, and certain other information.  

We will not discriminate against any person in violation of any United States federal or state law, or for exercising any of the consumer rights described above.

You may choose to contact your state Attorney General or your state’s designated consumer protection office for submitting a complaint about our Privacy practices.  


Colorado Resident Specific Rights

USPSA is including this section proactively to align with best practices and prepare for future regulatory applicability. USPSA does not currently meet the threshold requirements for mandatory compliance with the Colorado Privacy Act ("CPA"); however, we are voluntarily adopting these standards as part of our commitment to member privacy.

To the extent any Colorado data privacy law applies to the collection of your Information, this supplemental section of our Privacy Policy outlines the individual rights guaranteed to Colorado residents and how to exercise those rights and applies solely to Colorado residents.  We provide the supplemental section below to comply with the CPA and any terms defined in the CPA have the same meaning when used below.

Your Rights under CPA

Subject to certain exceptions you may be entitled to the following rights:

  • Right to Access & Data Portability. You have the right to request that we disclose certain information to you about our collection and use of your Personal Information at any time.  Once we receive and confirm an authenticated consumer request from you, we will, subject to certain exceptions:
  • Disclose whether we are processing your Personal Information.
  • Provide you with access to your Personal Information where we process it.
  • Where exercising your right to access, you have the right to request and obtain a copy of your Personal Information that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the Information to another data controller without hindrance (“data portability”).
  • Right to Correct Inaccurate Information. To the extent that we may maintain inaccurate Personal Information, you have the right to request that we correct such inaccurate Personal Information taking into account the nature of the Personal Information and the purposes of the processing of the Personal Information.  Once we receive and verify your authenticated consumer request, we will use commercially reasonable efforts to correct your Personal Information.
  • Right to Delete. You have the right to request that we delete certain of your Personal Information provided by or obtained about you.  To the extent that we can delete your Personal Information, once we receive and confirm your authenticated consumer request, we will delete your Personal Information, subject to certain exceptions.
  • Sale of Personal Information, Targeted Advertising, Profiling, and the Right to Opt Out. You have the right to opt out of the processing of your Personal Information for the following purposes:
  • Targeted advertising.
  • Sale of your Information.
  • Profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.
  • Right to Appeal. You have the right to appeal our denial of any request you make under this section.  To exercise your right to appeal, please submit an appeals request via the information in the Contact Us section below. Within forty-five (45) days of receipt of your appeal, we will inform you in writing of any action taken or not taken in response to your appeal, including a written explanation of the reasons for the decisions. California Resident Rights

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to contact us to prevent disclosure of Personal Data to third parties for such third parties’ direct marketing purposes; in order to submit such a request, please contact us at [email protected]

Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services that you do not wish such operators to track certain of your online activities over time and across different websites. Our Services do not support Do Not Track requests at this time. To find out more about “Do Not Track,” you can visit www.allaboutdnt.com. How to comply with the Colorado Privacy Act (“CPA”) and any terms defined in the CPA have the same meaning when used below.

 

8. Cookies 

The Services may use cookies and similar technologies such as pixel tags, web beacons, clear GIFs and JavaScript (collectively, “Cookies”) to enable our servers to recognize your web browser, tell us how and when you visit and use our Services, analyze trends, learn about our user base and operate and improve our Services. Cookies are small pieces of data– usually text files – placed on your computer, tablet, phone or similar device when you use that device to access our Services. We may also supplement the information we collect from you with information received from third parties, including third parties that have placed their own Cookies on your device(s). Please note that because of our use of Cookies, the Services do not support “Do Not Track” requests sent from a browser at this time.

When you visit or log in to our Services, cookies and similar technologies may be used by our online data partners or vendors to associate these activities with other personal information they or others have about you, including by association with your email or home address. We (or service providers on our behalf) may then send communications and marketing to these email or home addresses.

You can decide whether or not to accept Cookies through your internet browser’s settings. Most browsers have an option for turning off the Cookie feature, which will prevent your browser from accepting new Cookies, as well as (depending on the sophistication of your browser software) allow you to decide on acceptance of each new Cookie in a variety of ways. If you do this, however, you may have to manually adjust some preferences every time you visit our Services and some of the services and functionalities may not work.

We partner with third-party sponsors, affiliates, vendors, and other companies who might have links, content, or applications on the Sites. We do not control these third parties’ tracking technologies or how they may be used. 9. AI Intelligence and ChatBot Use

We may, from time to time, or consistently deploy and make use of tools developed and run by us or a third-party vendor which makes use of artificial intelligence (“AI”) to better facilitate the provision of Services to you. AI chatbots may also be deployed to assist you with inquiries and customer service tasks. While these text chats may appear as if they are from a real human being, they are not and responses are automated.

 

10. Business transfers

If we or our assets are acquired, or in the unlikely event that we go out of business or enter bankruptcy, we would include data among the assets transferred to any parties who acquire us. You acknowledge that such transfers may occur, and that any parties who acquire us may continue to use your personal information according to this policy.

 

11. Data That is Not Personal Data

We may create aggregated, de-identified or anonymized data from the Personal Data we collect, including by removing information that makes the data personally identifiable to a particular user. We may use such aggregated, de-identified or anonymized data and share it with third parties for our lawful business purposes, including to analyze, build and improve the Services and promote our business, provided that we will not share such data in a manner that could identify you.  We will not re-identify such aggregated, de-identified or anonymized data.

 

12. Data Security

We seek to protect your Personal Data from unauthorized access, use and disclosure using appropriate physical, technical, organizational and administrative security measures based on the type of Personal Data and how we are processing that data. Encryption is our security strategy to ensure the stored Personal Data can be accessed only by the authorized roles and services with audited access to the encryption keys. Personal information/data is encrypted and stored in a private and isolated environment for extended security.

Although we work to protect the security of your data that we hold in our records, please be aware that no method of transmitting data over the internet or storing data is completely secure.

 

13. Consequences of not Providing your Data

You are not obligated to provide your Personal Data to us. However, there may be times where your information is required for us to provide you with our Services, deliver requested products, or provide you with the content, feedback, or other materials that you request from us. In certain situations, we will not be able to offer some or all of our products or Services to you without requesting or collecting your Personal Data.

 

14. Data Retention 

We retain Personal Data about you for as long as necessary to provide you with our Services or to perform our business or commercial purposes for collecting your Personal Data. When establishing a retention period for specific categories of data, we consider who we collected the data from, our need for the Personal Data, why we collected the Personal Data, and the sensitivity of the Personal Data. In some cases we retain Personal Data for longer, if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, or is otherwise permitted or required by applicable law, rule or regulation. We may further retain information in an anonymous or aggregated form where that information would not identify you personally.

For example:

  • We retain your profile information and credentials for as long as you have an account with us.
  • We retain your payment data for as long as we need to process your purchase or subscription.
  • We retain your device/IP data for as long as we need it to ensure that our systems are working appropriately, effectively and efficiently.

 

15. Limits of our policy

Our website may link to external sites that are not operated by us. Please be aware that we have no control over the content and policies of those sites and cannot accept responsibility or liability for their respective privacy practices.
 

16. Changes to this policy 

At our discretion, we may change our privacy policy to reflect current acceptable practices. We will take reasonable steps to let users know about changes via our website. 
Your continued use of this site after any changes to this policy will be regarded as acceptance of our practices around privacy and personal information.

If we make a significant change to this privacy policy, for example changing a lawful basis on which we process your personal information, we will ask you to re-consent to the amended privacy policy.
